OS, Inc., a business associate (BA), reported that one of its employees was the victim of an email phishing scheme that affected the electronic protected health information (ePHI) of 46,578 individuals. The ePHI involved included names, birthdates, addresses, Social Security numbers, claims information, diagnoses/conditions, lab results, and medications prescribed. The BA notified HHS, affected individuals, the media, and provided substitute notice. In its mitigation efforts, the BA implemented new technical safeguards and retrained its staff on email security precautions. OCR obtained assurances that the CE implemented the corrective actions noted.
