La Clínica de La Raza, Inc., the covered entity (CE), reported that a mobile device containing the electronic protected health information (ePHI) of 2,477 individuals was stolen from a workforce member’s vehicle. The ePHI involved included names, dates of birth, medical record numbers, and lab results. The CE notified HHS, affected individuals, the media, and posted substitute notice on its website. As a result of OCR’s investigation, the CE revised its HIPAA policy and procedures, retrained its workforce members, and implemented additional physical and technical safeguards to better protect its ePHI. OCR obtained assurances that the CE implemented the corrective actions noted. OCR also provided technical assistance to the CE.
