The covered entity (CE), DJO, reported that an employee of its former business associate was the victim of an email phishing attack that affected the electronic protected health information (ePHI) of 3,429 individuals. The ePHI involved included names, Social Security numbers, dates of birth, addresses, health insurance information, and medical diagnoses and treatment information. The CE notified HHS, affected individuals, the media, and posted substitute notice on its website. In response to the breach, the CE implemented additional administrative and technical safeguards and retrained its staff on recognizing and responding to fraudulent email communications. OCR obtained assurances that the CE implemented the corrective actions noted.
